What should I do immediately after being injured on someone else’s dangerous property?

Unfortunately, it is common for people to be injured due to dangerous conditions in retail stores, restaurants, parking lots and even other people’s homes. If you suffered injuries in a slip-and-fall or other serious accident, the property owner may be liable under certain circumstances.

After the accident, your first priority should be to seek medical attention. While waiting for an ambulance or other assistance, you may be able to gather useful evidence for later. If possible, you should take pictures of the area where the accident occurred and ask for contact information from witnesses. You also need to report the injury to the property owner or manager, if they didn’t personally witness it. Can I seek compensation if I was injured by a product that is already known to be dangerous?

Yes, depending on the specifics of the accident and how/why it occurred. Some products are inherently dangerous even when used correctly. To some extent, you assume these obvious risks as the person who purchased the product. However, manufacturers and retailers are still responsible for ensuring the product does not malfunction under normal use, and they must include adequate warnings and instructions.

If you were using a chemical paint stripper, for instance, you likely already knew that the product shouldn’t be ingested or make contact with your eyes. But let’s say you were injured after using the product indoors in a nonventilated area because the manufacturer never included a warning against it. Under such circumstances, the manufacturer could potentially be liable.

I am a railroad worker who was injured on the job. Can I seek workers’ compensation?

Most workers in New York are eligible for workers’ compensation when injured on the job. However, railroad workers are not. Instead, they can seek compensation under a law called the Federal Employers Liability Act, or FELA.

The disadvantage to pursuing a FELA claim is that you need to prove that your injuries were due, at least in part, to the negligence of your employer. Proving fault is not necessary in a workers’ comp claim.

However, one of the main advantages to FELA claims is the potential for much greater compensation than you could achieve in a workers’ comp claim. Workers’ comp doesn’t include benefits for things like pain and suffering, but such damages are available in FELA claims.
