After the accident, your first priority should be to seek medical attention. While waiting for an ambulance or other assistance, you may be able to gather useful evidence for later. If possible, you should take pictures of the area where the accident occurred and ask for contact information from witnesses. You also need to report the injury to the property owner or manager, if they didn’t personally witness it. Can I seek compensation if I was injured by a product that is already known to be dangerous?

Yes, depending on the specifics of the accident and how/why it occurred. Some products are inherently dangerous even when used correctly. The disadvantage to pursuing a FELA claim is that you need to prove that your injuries were due, at least in part, to the negligence of your employer. Proving fault is not necessary in a workers’ comp claim.

However, one of the main advantages to FELA claims is the potential for much greater compensation than you could achieve in a workers’ comp claim. Workers’ comp doesn’t include benefits for things like pain and suffering, but such damages are available in FELA claims.
